The Assumption AdvantageTM

Terms of Use

These Terms of Use (“Terms”) govern your access to assumptionadvantage.com and The Assumption Advantage™ website, calculator, educational materials, property offerings, QR links, and related features (collectively, the “Service”). The Service is operated by Lawrence Paul, doing business as The Assumption Advantage™ (“we,” “us,” or “our”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Adult Use

You must be at least 18 years old and legally capable of entering into an agreement to use the Service. The Service is intended for use in the United States.

2. Educational and Illustrative Service

The Service provides educational calculations and illustrative comparisons concerning potentially assumable mortgages, alternative financing, cash requirements, ownership periods, and related transaction considerations. It is not a loan application, loan approval, commitment to lend, credit decision, appraisal, title report, legal opinion, tax opinion, accounting advice, investment advice, or substitute for professional advice.

Use of the Service alone does not create a lender-borrower, mortgage-broker-client, real-estate agency, fiduciary, attorney-client, or other professional relationship. Any regulated or professional service must be established separately in writing and will be subject to its own disclosures and agreements.

3. No Guarantee of Assumability, Financing, or Closing

A mortgage may be assumed only if the loan holder or servicer permits and approves the assumption under the applicable loan documents, program requirements, underwriting standards, and law. A property, buyer, seller, or proposed transaction may not qualify.

The Service does not guarantee that a loan is assumable; that a servicer will process or approve an assumption; that any person will qualify for an assumption or other financing; that any lender will offer the illustrated amount, rate, term, combined-loan limit, fees, or proceeds; that a seller will offer a junior-lien mortgage or accept an offer; that a veteran will receive a release of liability or restoration or substitution of VA entitlement; that any supplied information is complete or current; or that a transaction will close.

4. Calculator Assumptions and Limitations

Results depend on the information entered and on simplifying assumptions. Calculations may exclude or estimate lender overlays, credit qualification, points, mortgage insurance, funding fees, closing adjustments, title and settlement charges, prepaid items, escrow requirements, taxes, insurance changes, maintenance, opportunity cost, tax consequences, appreciation or depreciation, investment returns, refinancing, early payoff, program changes, and other transaction-specific factors.

Rates, costs, institutional-second parameters, and program limits shown are illustrative unless expressly identified as a current written quote. Even when a source or observation date is displayed, information may be delayed or may not apply to you. Confirm all figures directly with the loan holder, lender, settlement professional, insurer, taxing authority, and other appropriate professionals.

5. User Responsibilities

You are responsible for providing accurate information; independently verifying property, mortgage, payoff, escrow, financing, and closing information; disclosing all financing and obligations as required; obtaining appropriate professional advice; and using the Service lawfully.

Do not enter another person’s private information without authority. Do not attempt to bypass access controls, probe the Service, introduce malicious code, scrape data, impersonate another person, interfere with operation, or use the Service to discriminate or violate fair-housing, consumer-protection, lending, privacy, or other laws.

6. Seller Offerings and Buyer Scenarios

Seller-provided terms are examples of terms a seller may consider and are not binding commitments unless included in a separately signed agreement. Buyer scenarios are estimates and do not reserve a property, establish financing, or modify a seller offering. A seller may change or withdraw an offering, subject to any separate binding agreement and applicable law.

Any seller-provided second mortgage or junior lien must be separately documented, must comply with applicable law, and must be disclosed to the loan holder, lender, settlement professional, and other parties when required. It may require approval, acceptable lien priority, and third-party servicing. The Service does not determine whether a proposed obligation is permitted or how it will be treated in underwriting.

A new Buyer may receive one limited starter result. Full results, additional scenarios, saved-scenario access, and report printing or downloading may require successful verification of both the supplied email address and a supported mobile number. We may restrict, suspend, or revoke access when verification fails or the Service is misused.

7. Communications and Referrals

If you affirmatively consent, we may personally contact you about the property you selected and mortgage-assumption information. Consent is not a condition of a property purchase or other transaction, and you may ask us to stop.

We will not disclose your contact information to an outside mortgage, real-estate, assumption-service, legal, settlement, or other referral professional without a separate authorization when required by our Privacy Policy or applicable law. If you request or authorize a referral, we may receive compensation when legally permitted and appropriately disclosed. We do not guarantee or endorse an outside professional. You remain free to select your own providers.

8. Intellectual Property

The Service, including its software, calculation structure, page design, text, graphics, branding, reports, and educational materials, is owned by or licensed to Lawrence Paul and is protected by applicable intellectual-property laws. “The Assumption Advantage™” and associated branding are claimed as trademarks.

We grant you a limited, revocable, nonexclusive, nontransferable right to use the Service for your personal evaluation of a potential transaction. You may print or share a generated analysis for that transaction, provided you do not remove notices or present it as a lender approval or professional opinion. You may not copy, reproduce, reverse engineer, sell, license, republish, create a competing derivative service from, or commercially exploit the Service without prior written permission.

9. Third-Party Information and Links

The Service may display or link to information from sellers, listing services, government sources, lenders, or other third parties. We do not control and are not responsible for third-party information, websites, products, services, availability, security, or privacy practices. A link or reference does not necessarily constitute endorsement.

10. Availability and Changes

We may modify, suspend, restrict, or discontinue any part of the Service and may correct errors at any time. We do not promise uninterrupted availability or permanent storage of any scenario or other information. Keep your own copy of any analysis you wish to retain.

11. Disclaimer of Warranties

To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of accuracy, completeness, currency, merchantability, fitness for a particular purpose, title, and noninfringement. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

12. Limitation of Liability

To the fullest extent permitted by law, Lawrence Paul and The Assumption Advantage™ will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost opportunities, lost data, financing decisions, transaction failures, or reliance on calculator results arising from or related to the Service. Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

13. Indemnification

To the extent permitted by law, you agree to be responsible for losses, claims, and reasonable costs resulting from your unlawful misuse of the Service, your material violation of these Terms, or information you submit without authority. This provision does not require you to indemnify us for our own unlawful conduct.

14. Governing Law

These Terms are governed by the laws of South Carolina, without regard to conflict-of-law principles, except to the extent federal law or the mandatory law of another jurisdiction applies. Any dispute must be brought in a court with lawful jurisdiction. This provision does not waive rights or remedies that cannot legally be waived.

15. Changes to These Terms

We may update these Terms by posting a revised version with a new effective date. Your continued use after the effective date constitutes acceptance of the revised Terms.

16. Contact
